TERMS OF SERVICE
These Terms of Service ("Terms") form a binding agreement between you and TrySomeGames ("we", "us", "our") regarding your use of TrySomeGames.com, our browser-based games, and any related services (together, the "Services"). By accessing or using the Services you confirm that you have read, understood and accepted these Terms as well as our Privacy Policy. If you do not agree, please do not use the Services.
1. Who we are
TrySomeGames is operated from Sweden and acts as the data controller for personal data processed through the Services within the meaning of the EU General Data Protection Regulation (GDPR). You can reach us at contact@trysomegames.com for any legal, privacy or account-related request.
2. Acceptance and changes to the Terms
We may update these Terms from time to time to reflect changes in the Services, in applicable law or in our business practices. Material changes will be announced on the site and, where required, communicated to registered users in advance. Your continued use of the Services after the effective date of the updated Terms constitutes acceptance of the changes. If you do not accept the updated Terms, you must stop using the Services.
3. Eligibility and children
The Services are intended for users aged 13 and above. If you are between 13 and the age of digital consent in your country (13–16 in the EU/EEA depending on national law), you may only use the Services and create an account with the verifiable consent of a parent or legal guardian. We do not knowingly collect personal data from children below the applicable age. If you believe a child has provided us with personal data, please contact us and we will delete it.
4. Accounts and account security
Some features require you to create an account. You must provide accurate information, keep your credentials confidential, and are responsible for all activity that takes place under your account. You must notify us without undue delay if you suspect unauthorised access. We may suspend or close accounts that violate these Terms, applicable law, or that pose a security or safety risk.
5. Acceptable use
You agree not to: (a) use the Services for any illegal, fraudulent or harmful purpose; (b) interfere with, probe, scan or disrupt the Services, servers or networks; (c) attempt to gain unauthorised access to any account, data or system; (d) use bots, scrapers or automated systems to extract data or manipulate gameplay; (e) harass, threaten, defame or discriminate against other users; (f) upload malware, illegal content or content that infringes the rights of others; (g) misuse advertising, referral or supporter features. Violation may result in warnings, feature restrictions, or immediate termination of access.
6. User content and reviews
You retain the rights to content you submit (such as reviews, comments or feedback). By submitting content you grant us a worldwide, non-exclusive, royalty-free, transferable licence to host, store, display, adapt and distribute it as part of operating and promoting the Services. You are responsible for the content you submit and confirm that it does not infringe any third-party rights or applicable law. We may moderate, edit or remove content at our discretion, in particular where it violates these Terms.
7. Intellectual property
All content forming part of the Services — including games, source code, graphics, audio, text, logos and trademarks — is owned by TrySomeGames or its licensors and is protected by copyright, trademark and other intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes. Any other use requires our prior written consent.
8. Pricing, payments and consumer rights
All prices shown for supporter memberships (monthly and yearly), one-time donations and any optional in-game items are the total amount payable at checkout in the displayed currency. Payments are processed by our payment provider (Stripe) which acts as an independent controller for payment data. Memberships renew automatically until cancelled from your account or through the customer portal. As a consumer in the EU/EEA you normally have a 14-day right of withdrawal for distance contracts; by starting to use the digital Services immediately after purchase you expressly agree that the right of withdrawal is lost once performance begins, in accordance with Article 16(m) of Directive 2011/83/EU. Statutory refund rights under mandatory local law are not affected.
9. Advertising and third-party services
The Services may display advertising served by Google AdSense and other advertising partners, and may include links to third-party sites, tools or content. Third parties, including Google, may use cookies, device identifiers and similar technologies to serve ads based on your prior visits to this and other websites. You can control personalised advertising through the consent banner shown on the site, through Google Ads Settings (https://adssettings.google.com), through https://www.youronlinechoices.eu, or via your browser settings. We do not endorse and are not responsible for the content, policies or practices of third-party services, which are governed by their own terms and privacy policies.
10. Cookies and consent
We use strictly necessary cookies to operate the Services and, subject to your consent, advertising cookies (including cookies set by Google AdSense) to serve and measure ads and, where you allow it, personalise advertising. You can grant, refuse or withdraw your consent at any time via the cookie settings link available on the site. Refusing non-essential cookies does not affect access to the core Services.
11. Privacy and your GDPR rights
We process personal data in accordance with our Privacy Policy and applicable data protection law (including the GDPR and the Swedish Data Protection Act). Depending on your situation, you have the right to: access your personal data; request rectification or erasure; restrict or object to processing; data portability; and withdraw any consent you have given (without affecting the lawfulness of processing prior to withdrawal). You also have the right to lodge a complaint with a supervisory authority, in Sweden the Integritetsskyddsmyndigheten (IMY, https://www.imy.se). To exercise your rights, contact contact@trysomegames.com. For details on categories of data, legal basis, retention periods and international transfers, see our Privacy Policy.
12. Service availability and modifications
We continuously develop the Services and may add, change, suspend or discontinue features at any time. We aim for high availability but do not guarantee that the Services will be uninterrupted, timely, secure or error-free. Scheduled or emergency maintenance may temporarily limit access. Where technically feasible we will inform registered users of significant changes that materially affect a paid feature.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. This does not limit any statutory rights you may have as a consumer that cannot be excluded under mandatory local law.
14. Limitation of liability
To the maximum extent permitted by law, TrySomeGames shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, use or goodwill, arising out of or in connection with your use of the Services. Nothing in these Terms limits or excludes our liability for gross negligence, wilful misconduct, personal injury caused by our negligence, or any other liability that cannot be limited or excluded under applicable law.
15. Indemnification
You agree to indemnify and hold harmless TrySomeGames and its personnel from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services or your violation of any law or third-party right.
16. Termination
You may stop using the Services and close your account at any time from your account settings. We may suspend or terminate your access to all or part of the Services, with or without notice, if you breach these Terms, if required by law, or to protect the Services and other users. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification and governing law) will remain in effect.
17. Governing law and disputes
These Terms are governed by the laws of Sweden, without regard to its conflict of law principles. If you are a consumer resident in the EU/EEA, you also benefit from the mandatory protections of the law of your country of residence. Disputes shall be resolved by the competent courts of Sweden, unless mandatory consumer law provides otherwise. The European Commission provides an Online Dispute Resolution platform for consumers at https://ec.europa.eu/consumers/odr.
18. Contact
